These Terms & Conditions govern the SMS text messaging program (the “Program”) operated by MJ Simpson Properties, LLC (d/b/a BlackcapX) (“we,” “us,” or “our”). By opting in to receive text messages from us, you agree to these Terms & Conditions. Please also review our Privacy Policy, which describes how we collect, use, and protect your information.

You will only receive text messages under this Program if you have provided prior express consent in one of the following ways:

By checking the consent box or replying YES, you expressly consent to receive text messages, including messages sent using automated technology, and phone calls, including automated phone calls, from MJ Simpson Properties, LLC (d/b/a BlackcapX) at the mobile number you provided. Consent applies only to this Program and is not transferable or assignable.

Consent is not a condition of purchasing any goods or services or of booking a showing.

3. Message Frequency

Message frequency varies based on your appointment activity and your interactions with us.

4. Fees and Charges

Message and data rates may apply. Standard messaging and data charges from your mobile carrier may apply to each message sent and received. Please contact your mobile carrier for details regarding your plan.

5. How to Opt Out

You may opt out of the Program at any time by replying STOP to any text message you receive from us. After texting STOP, you will receive one final message confirming your opt-out, and no further messages will be sent to you unless you opt in again. 7. Privacy

Your mobile information will be handled in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

8. Supported Carriers and Carrier Liability

The Program is offered on most major U.S. mobile carriers. Carriers are not liable for delayed or undelivered messages. We are not responsible for delays or failures in message delivery, which may depend on your carrier, device, network coverage, or other factors outside our control.

9. Eligibility

You must be at least 18 years of age and the account holder (or have the account holder’s permission) for the mobile number provided to participate in the Program.

10. Changes to the Program or These Terms

We may modify, suspend, or discontinue the Program, or update these Terms & Conditions, at any time. Changes will be posted on this page with an updated effective date. Your continued participation in the Program after changes are posted constitutes your acceptance of the revised Terms & Conditions.

11. Disclaimer and Limitation of Liability

The Program is provided on an “as is” basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, regarding the Program, and we will not be liable for any indirect, incidental, or consequential damages arising out of or related to your participation in the Program.
